Terms of service.
1) Acceptance of Terms
By downloading, accessing, or using VeganKey, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the app. You also agree to our Privacy Policy located at [https://vegankey.app/privacy] (update URL before submission).
2) Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your region). If you are under 18, you represent that you have guardian permission.
3) What VeganKey Does (and Doesn’t)
VeganKey analyzes user-captured menu images and returns informational classifications (e.g., Vegan, Modifiable, Not Vegan) and suggested modifications. VeganKey does not guarantee that any item is 100% vegan, allergen-free, or suitable for your dietary needs. Always verify with the restaurant.
4) No Advice; Informational Use Only
VeganKey is not medical, nutritional, legal, or professional advice. Outputs may be incomplete, outdated, or incorrect. You are solely responsible for your dining decisions.
5) Assumption of Risk & Voluntary Use
You understand and agree that using VeganKey is voluntary and at your own risk. You assume all risks related to relying on the app’s outputs, including risks of consuming ingredients you seek to avoid and any allergic reactions.
6) Account, Access & Features
Certain features (e.g., favorites, history, subscriptions) may require an account. You’re responsible for your credentials and all activity under your account. We may add, change, or discontinue features at any time.
7) License & Intellectual Property
We grant you a limited, personal, non-exclusive, non-transferable license to use VeganKey for lawful, personal purposes. All rights not expressly granted are reserved by VeganKey and its licensors. Do not copy, modify, reverse engineer, or resell the app or its content.
8) User Content & License to Process
You retain ownership of images and content you submit. You grant VeganKey a worldwide, non-exclusive, royalty-free license to host, process, analyze, cache, and display your submitted content solely to operate the app (including history/favorites) and improve quality and safety. Do not upload content you don’t have rights to share.
9) Acceptable Use
You agree not to:
a) infringe IP or privacy rights;
b) upload unlawful, deceptive, or harmful content;
c) circumvent security;
d) scrape, bulk download, or build competing datasets;
e) misuse or interfere with the app’s normal operation.
10) Third-Party Services
We use service providers to deliver the app (e.g., AWS for storage/hosting, OpenAI for menu understanding). Their use of data is limited to providing services to us, as described in the Privacy Policy.
11) Subscriptions & Payments (if applicable)
If VeganKey offers paid features: prices, billing periods, free trials, and renewal terms are shown at purchase. Subscriptions renew automatically unless canceled in your Apple ID settings at least 24 hours before the end of the current period. Taxes may apply. Refunds follow Apple’s policies.
12) Apple-Required Terms (iOS)
These Terms are between you and VeganKey, not Apple. VeganKey, not Apple, is responsible for the app and its content. Apple has no obligation to furnish maintenance or support.
Warranty: To the maximum extent permitted by law, Apple has no warranty obligations.
Claims: Apple is not responsible for any claims relating to the app (product liability, legal compliance, consumer protection), or IP claims.
Third-Party Beneficiary: Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them.
13) Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ACCURACY, RELIABILITY, OR AVAILABILITY, OR THAT OUTPUTS WILL MEET YOUR NEEDS.
14) Liability Waiver & Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VEGANKEY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY, ALLERGIC REACTIONS, DATA LOSS, LOSS OF PROFITS, OR OTHER LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ITS OUTPUTS.
WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY IS LIMITED TO THE LESSER OF: (A) THE AMOUNT YOU PAID TO VEGANKEY FOR THE APP/SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.
THIS SECTION DOES NOT LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR OTHER LIABILITIES THAT CANNOT BE EXCLUDED BY LAW.
15) Indemnification
You agree to defend, indemnify, and hold harmless VeganKey and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the app, your content, or your violation of these Terms or applicable law.
16) Intellectual Property Complaints (DMCA)
If you believe content in the app infringes your copyright, email support@vegankey.app with: (i) your contact info, (ii) identification of the copyrighted work, (iii) identification of the allegedly infringing material, (iv) a statement under penalty of perjury of good-faith belief, (v) a statement of authority to act, and (vi) a signature. We may remove content and, where appropriate, terminate repeat infringers.
17) Changes to the App or Terms
We may modify the app and these Terms at any time. If we make material changes, we’ll update the Effective Date and may provide notice in-app. Continued use after changes means you accept the updated Terms.
18) Suspension & Termination
We may suspend or terminate access for any violation of these Terms, suspected fraud, or legal/compliance reasons. You may stop using the app at any time and request deletion of your account/data per our Privacy Policy.
19) Governing Law; Disputes
These Terms are governed by the laws of [State/Region], without regard to conflict of laws rules.
Optional (replace or remove): Any dispute will be resolved by binding arbitration in [City, State], administered by [Arbitration Body] under its rules. You and VeganKey waive class actions. You may pursue individual claims in small-claims court. This clause does not limit any non-waivable consumer rights.
20) Severability; Assignment; Entire Agreement
If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset sale. These Terms, plus the Privacy Policy, are the entire agreement regarding the app.
